{"id":6576,"date":"2014-08-25T13:54:57","date_gmt":"2014-08-25T11:54:57","guid":{"rendered":"http:\/\/kehila-olomouc.cz\/rs\/?p=6576"},"modified":"2015-11-16T14:49:16","modified_gmt":"2015-11-16T12:49:16","slug":"informace-o-pozemcich-bez-dedicu","status":"publish","type":"post","link":"https:\/\/kehila-olomouc.cz\/rs\/6576\/informace-o-pozemcich-bez-dedicu\/","title":{"rendered":"Informace o pozemc\u00edch bez d\u011bdic\u016f"},"content":{"rendered":"<p>Dne 1. 1. 2014 nabyl \u00fa\u010dinnosti z\u00e1kon \u010d. 256\/2013 Sb., o katastru nemovitost\u00ed (d\u00e1le jen katastr\u00e1ln\u00ed z\u00e1kon), kter\u00fd v \u00a7 64 ukl\u00e1d\u00e1 \u010cesk\u00e9mu \u00fa\u0159adu zem\u011bm\u011b\u0159ick\u00e9mu a katastr\u00e1ln\u00edmu p\u0159edat \u00da\u0159adu pro zastupov\u00e1n\u00ed st\u00e1tu ve v\u011bcech majetkov\u00fdch (d\u00e1le jen \u00daZSVM) \u00fadaje o nemovitostech, u nich\u017e nen\u00ed osoba dosud zapsan\u00e1 v katastru nemovitost\u00ed jako vlastn\u00edk nebo jin\u00fd opr\u00e1vn\u011bn\u00fd ozna\u010dena\u00a0<b>dostate\u010dn\u011b ur\u010dit\u011b (osud nezn\u00e1m\u00fd)<\/b>.<\/p>\n<p>V \u00a7 65 katastr\u00e1ln\u00edho z\u00e1kona se \u00daZSVM ukl\u00e1d\u00e1 v\u00e9st o nemovitostech s nejednozna\u010dn\u00fdm vlastn\u00edkem evidenci, tuto evidenci zve\u0159ejnit na sv\u00fdch internetov\u00fdch str\u00e1nk\u00e1ch a \u00fadaje p\u0159edat obecn\u00edmu \u00fa\u0159adu, na jeho\u017e \u00fazem\u00ed se nemovitost nach\u00e1z\u00ed, s t\u00edm, \u017ee obecn\u00ed \u00fa\u0159ad \u00fadaje zve\u0159ejn\u00ed na \u00fa\u0159edn\u00ed desce. D\u00e1le z\u00e1kon ukl\u00e1d\u00e1 \u00daZSVM prov\u00e9st v sou\u010dinnosti s p\u0159\u00edslu\u0161n\u00fdm obecn\u00edm \u00fa\u0159adem \u0161et\u0159en\u00ed k dohled\u00e1n\u00ed vlastn\u00edka.<\/p>\n<p>Zjist\u00ed-li \u00daZSVM osobu vlastn\u00edka nemovitosti, p\u00edsemn\u011b ho vyzve, aby p\u0159edlo\u017eil listiny dokl\u00e1daj\u00edc\u00ed jeho vlastnictv\u00ed p\u0159\u00edslu\u0161n\u00e9mu katastr\u00e1ln\u00edmu \u00fa\u0159adu, nebo uplatnil sv\u00e1 vlastnick\u00e1 pr\u00e1va v ob\u010danskopr\u00e1vn\u00edm \u0159\u00edzen\u00ed.\u00a0<b>P\u0159ihl\u00e1s\u00ed-li se \u00daZSVM osoba<\/b>, kter\u00e1 tvrd\u00ed, \u017ee je vlastn\u00edkem nemovitosti, \u00daZSVM ji p\u00edsemn\u011b vyzve, aby listiny dokl\u00e1daj\u00edc\u00ed jej\u00ed vlastnictv\u00ed p\u0159edlo\u017eila katastr\u00e1ln\u00edmu \u00fa\u0159adu, nebo\u00a0<b>uplatnila sv\u00e1 vlastnick\u00e1 pr\u00e1va v ob\u010danskopr\u00e1vn\u00edm \u0159\u00edzen\u00ed<\/b>.<\/p>\n<p>Nepoda\u0159\u00ed-li se vlastn\u00edka zjistit a ub\u011bhne-li lh\u016fta podle ob\u010dansk\u00e9ho z\u00e1kon\u00edku, m\u00e1 se za to, \u017ee nemovitost je opu\u0161t\u011bn\u00e1. Toto ustanoven\u00ed z\u00e1kona vych\u00e1z\u00ed ze skute\u010dnosti, \u017ee k vlastnictv\u00ed takov\u00fdch nemovitost\u00ed se dlouhodob\u011b nikdo nehl\u00e1s\u00ed, neplat\u00ed z nich dan\u011b, nepe\u010duje o n\u011b, a tak lze p\u0159edpokl\u00e1dat, \u017ee tyto osoby nevykon\u00e1vaj\u00ed vlastnick\u00e9 pr\u00e1vo ke sv\u00fdm nemovitostem ve smyslu \u00a7 1050 odst. 2 nov\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku. Po uplynut\u00ed 10 let nevykon\u00e1v\u00e1n\u00ed vlastnick\u00e9ho pr\u00e1va se nemovitost pova\u017euje za opu\u0161t\u011bnou a st\u00e1v\u00e1 se vlastnictv\u00edm st\u00e1tu.<\/p>\n<p>Pokud osoba (fyzick\u00e1 nebo pr\u00e1vnick\u00e1) zjist\u00ed, \u017ee je vlastn\u00edkem nemovitosti uveden\u00e9 na seznamu zve\u0159ejn\u011bn\u00e9m na webov\u00e9 adrese\u00a0<a href=\"http:\/\/www.uzsvm.cz\/nedostatecne-urcite-identifikovani-vlastnici-2140-0-85\/\" target=\"_blank\">http:\/\/www.uzsvm.cz\/nedostatecne-urcite-identifikovani-vlastnici-2140-0-85\/<\/a>, m\u016f\u017ee se obr\u00e1tit na m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00e9 odlou\u010den\u00e9 nebo \u00fazemn\u00ed pracovi\u0161t\u011b \u00daZSVM, jeho\u017e kontaktn\u00ed \u00fadaje nalezne na t\u00e9\u017ee webov\u00e9 adrese. M\u00edstn\u011b p\u0159\u00edslu\u0161n\u00e9 pracovi\u0161t\u011b \u00daZSVM porad\u00ed osob\u011b, kter\u00e1 nen\u00ed v katastru nemovitost\u00ed dostate\u010dn\u011b nebo v\u016fbec uvedena, jak d\u00e1le podle z\u00e1kona postupovat.<\/p>\n<p><b>Je d\u016fvodn\u00fd p\u0159edpoklad, \u017ee se v\u00a0mnoha p\u0159\u00edpadech jedn\u00e1 o b\u00fdval\u00fd \u017eidovsk\u00fd majetek.
